Welcome to Calm Mind ("we," "our," or "us"). By accessing, downloading, or using the Calm Mind platform, website, and all associated services (collectively, the "Services"), you confirm that you have read, understood, and agree to be legally bound by these Terms of Service ("Terms") and our Privacy Policy.

If you do not agree to any part of these Terms, you must immediately stop using our Services. These Terms constitute a legally binding agreement between you ("User") and Calm Mind.

Calm Mind is a digital wellness platform offering tools and content designed to support mindfulness, mental relaxation, focus, sleep improvement, and habit formation. Our Services include, but are not limited to:

• Guided Meditation Library — structured sessions from 2 to 30 minutes.
• Smart Breathing System — visual and timed breathing exercise programs.
• Breathing Challenge System — gamified breath-hold training with progress tracking.
• Sleep Optimization Tools — sleep stories, nature soundscapes, and night routines.
• Progress & Habit Tracking — local streak tracking, session logs, and analytics.
• Intelligent Reminders — adaptive browser-based wellness notifications.
• Deep Mind Modes — advanced psychological tools for specific mental states.
• Premium Subscription — unlocks exclusive content and advanced features.

We reserve the right to modify, suspend, or discontinue any part of the Services at any time, with or without notice. We will not be liable to you or any third party for any modification, suspension, or discontinuation of the Services.

Certain features of Calm Mind require you to create an account. When you register, you agree to:

• Provide accurate, current, and complete information during registration.
• Maintain and promptly update your account information.
• Keep your login credentials confidential and not share them with third parties.
• Accept responsibility for all activities that occur under your account.
• Notify us immediately at tsouvik486@gmail.com of any unauthorized use of your account.

Account authentication is handled via our secure authentication partner, Supabase. We do not store raw passwords. You may delete your account at any time by contacting us directly.

You agree to use Calm Mind for lawful, personal, and non-commercial wellness purposes only. You must not engage in any of the following:

• Using the platform to distribute illegal, harmful, offensive, or abusive content.
• Attempting to access, probe, or test the vulnerability of our systems or network.
• Reverse-engineering, decompiling, or attempting to extract source code from the Services.
• Using automated scripts, bots, or scrapers to access or interact with the platform.
• Impersonating any person or entity, or misrepresenting your affiliation with any person or entity.
• Circumventing, disabling, or interfering with security-related features of the platform.
• Reselling, sublicensing, or providing access to the Services to third parties for commercial gain.
• Uploading or transmitting any malware, viruses, or any code designed to disrupt or damage our systems.

Violation of this policy may result in immediate account termination without refund and, where applicable, referral to law enforcement authorities.

Calm Mind offers both a free tier and a paid Premium subscription. By subscribing to a Premium plan, you agree to the following additional terms:

• Billing Cycle: Subscriptions are billed on a recurring basis — either monthly or annually — depending on your selected plan.
• Auto-Renewal: Your subscription will automatically renew at the end of each billing cycle unless you cancel before the renewal date.
• Payment Processing: Payments are securely processed through Razorpay. We do not store your payment card information directly.
• Price Changes: We reserve the right to modify subscription pricing. We will provide at least 14 days' notice before any price increase takes effect.
• Refund Policy: We offer a 7-day refund window from the date of initial purchase if you are unsatisfied. Subsequent billing cycles are non-refundable once the renewal transaction has been processed.
• Cancellation: You may cancel your subscription at any time. Access to premium features will continue until the end of your current billing period.

All content within the Calm Mind platform — including but not limited to the design, layout, code, text, graphics, audio, animations, icons, and the Calm Mind name and logo — is the exclusive intellectual property of Calm Mind or its respective licensors, and is protected by applicable copyright, trademark, and intellectual property laws.

We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Services for your personal, non-commercial wellness purposes. This license does not include the right to:

• Reproduce, distribute, or publicly display any content from the platform without prior written consent.
• Modify, create derivative works from, or commercially exploit any platform content.
• Remove or alter any proprietary notices, labels, or marks on the platform.

Any feedback, suggestions, or ideas you submit regarding the Services may be used by us without any obligation to compensate you, and you hereby assign all rights to such submissions to Calm Mind.

Nothing on the Calm Mind platform — including meditation sessions, breathing exercises, sleep tools, habit tracking, or any AI-generated mental insights — constitutes professional medical advice, diagnosis, or treatment. You should always seek the advice of a qualified healthcare provider for any medical condition or mental health concern.

Certain breathing exercises (such as breath-hold challenges) may not be suitable for individuals with respiratory conditions, cardiovascular disease, pregnancy, or other health vulnerabilities. By participating in these exercises, you confirm that you are in suitable health to do so and that you do so entirely at your own risk.

If you are experiencing a mental health emergency, please contact emergency services or a crisis helpline immediately. Calm Mind does not provide emergency services.

Calm Mind integrates with certain third-party services to provide core functionality. By using Calm Mind, you also agree to the terms of these third-party providers where applicable:

We are not responsible for the content, policies, or practices of any third-party services. Links to external websites are provided for convenience and do not imply endorsement. We encourage you to review the privacy policies of any third-party services you interact with through our platform.

To the fullest extent permitted by applicable law, Calm Mind and its affiliates, operators, developers, and partners shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation:

• Loss of data, including meditation records, streaks, journal entries, or habit data stored locally.
• Loss of revenue or profits arising from your use or inability to use the Services.
• Physical or psychological harm arising from breathing exercises or meditation practices undertaken using the platform.
• Unauthorized access to or alteration of your personal data.

The Services are provided on an "as is" and "as available" basis without warranties of any kind, either express or implied, including merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Services will be uninterrupted, error-free, or free of harmful components.

Our total cumulative liability to you for all claims arising from these Terms or your use of the Services shall not exceed the amount you paid to us in the 12 months preceding the claim.

We reserve the right to suspend or permanently terminate your access to the Services at our sole discretion, without notice or liability, if we believe you have:

• Violated any provision of these Terms.
• Engaged in fraudulent, abusive, or illegal activity.
• Taken any action that harms the platform, its users, or its reputation.

You may also voluntarily terminate your account at any time by contacting us at tsouvik486@gmail.com. Upon termination, your right to use the Services will immediately cease and any locally stored data may be irretrievably lost.

Provisions of these Terms that by their nature should survive termination — including intellectual property rights, disclaimers, and limitations of liability — shall survive any termination.

These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law principles. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the competent courts located in West Bengal, India.

If any provision of these Terms is found to be invalid or unenforceable, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions of these Terms will remain in full force and effect.

We reserve the right to update or modify these Terms at any time. When we do, we will revise the "Last Updated" date at the top of this page. For material changes — those that significantly affect your rights or obligations — we will make reasonable efforts to notify you via the platform interface or the email associated with your account.

Your continued use of the Services after any such modification constitutes your acceptance of the updated Terms. If you do not agree to the revised Terms, you must stop using the Services immediately.
